Licence for the Instap Patient Viewer software

This document sets out the terms of use for IPV in the SaaS and on-premise models, covering both cloud deployments and installations in the infrastructure of a medical facility.

The licence takes effect upon signature of the deployment agreement or activation of the subscription. By using IPV, the licensee confirms that it has read the licence and undertakes to comply with all of its provisions, regardless of the distribution model selected.

The licence for the Instap Patient Viewer software sets out the rights and obligations of the parties, protects Instap’s intellectual property and ensures the proper processing of medical data. The document applies both to SaaS subscriptions and to local installation in the licensee’s infrastructure.

The detailed licence provisions are supplemented by the service agreement, the data processing terms and the technical documentation. This gives the licensee a full picture of the responsibilities, the scope of support and the technical requirements necessary for the safe operation of IPV.

Scope of the licence

Instap Sp. z o.o. grants a non-exclusive, non-transferable licence to use Instap Patient Viewer (IPV) in the cloud and local models, in accordance with the signed deployment agreement.

  • The right to use the core and optional IPV modules for patient monitoring, trend analysis and medical reporting.
  • The right to deploy test and training environments, provided that they are used solely for the licensee’s purposes.
  • The right to make backup copies to the extent necessary to restore the continuity of the system’s operation.

Authorised environments and users

The scope of IPV use is tied to the number of users, the number of instances and the selected distribution model.

  • The limit on users and instances follows from the licence package ordered and may be increased at the licensee’s request.
  • The licence does not cover granting third parties access to IPV without Instap’s prior consent, with the exception of subcontractors acting on behalf of the licensee.
  • Integrations with external systems are permitted only where compliance with the technical documentation and interoperability standards is maintained.

Licensee obligations

The licensee is responsible for the correct use of IPV, for compliance with the law and for preserving the integrity of medical data.

  • Appointing a service administrator responsible for overseeing users and data security.
  • Ensuring that patient data is processed on the appropriate legal bases (GDPR, national medical regulations).
  • Informing Instap without delay of security incidents and breaches of system integrity.

Support and maintenance

Instap provides technical support and software development under a service agreement or a maintenance package.

  • Reporting channels include the service portal, the hotline and a dedicated Customer Success team.
  • Security updates and critical fixes are delivered without delay once they have been prepared.
  • Functional extensions may be ordered in the form of additional modules or integration services.

Security and compliance

The licence sets out the data protection rules and the security standards required when using IPV.

  • Instap maintains compliance with the GDPR and with industry standards, and the licensee undertakes to apply equivalent standards on its side.
  • Access control mechanisms, multi-factor authentication and data encryption are required.
  • All service and integration work may be carried out only by authorised personnel.

Liability and warranties

The scope of the parties’ liability and the quality warranties are set out in the licence agreement and the service agreement.

  • Instap is responsible for the conformity of IPV with the functional specification and for removing reported defects within the agreed timeframes.
  • Instap’s total liability for damages is limited to the amount of the fees paid during the last 12 months of the licence term.
  • Instap is not liable for damage arising from unauthorised modifications, non-compliant integrations or use contrary to the documentation.

Specifics of the SaaS and on-premise licences

Licence in the SaaS model

Access to IPV provided from Instap Cloud with full operational support, monitoring and an SLA guarantee.

  • Access to IPV is provided through Instap Cloud using dedicated SaaS tenants and identity federation.
  • Billing is on a subscription basis (monthly or annual), with the option to scale the number of users and modules dynamically.
  • Instap is responsible for hosting, backups, monitoring and disaster recovery within the SLA parameters.
  • Functional updates and security fixes are deployed automatically, with advance notice of planned maintenance windows.
  • Data is stored in data centres within the EU, and the licensee has access to data export and copies in accordance with the data processing agreement.
  • The licensee undertakes to use secure network connections, to manage identities and to audit user activity.

Licence in the on-premise model

Deployment of IPV on the licensee’s servers, with security policies and maintenance procedures kept on the facility’s side.

  • The software is deployed in the licensee’s infrastructure using the supplied installation packages and hardening instructions.
  • The licence covers one production instance and test environments; additional installations require an extension of the licence.
  • The licensee is responsible for maintaining the servers and backups and for physical and environmental security.
  • Updates are delivered as version packages; Instap may provide a service to deploy them remotely or on site.
  • Integrations with HIS and LIS systems or archiving modules are carried out using certified Instap connectors.
  • All configuration changes must be documented in a change log and may be subject to audit by Instap.

The cloud environment managed by Instap that provides hosting, maintenance and security for IPV instances.

The licensee’s IT infrastructure in which IPV and the integration components are installed.

Final provisions

Summary and updates to the document

The professional IPV licence combines the requirements common to both distribution models with the separate obligations specific to SaaS and to on-premise installations. Keeping the provisions consistent with the service agreement, the data processing terms and the technical documentation ensures transparent cooperation and patient safety.

Instap reserves the right to update the licence terms in connection with regulatory changes, the deployment of new modules or security improvements. Licensees are notified at least 30 days in advance, and continued use of IPV after that date constitutes acceptance of the updated terms.
